WELCOME

 
These terms govern your use of unsuited.com and the services we provide through it. "We", "us" and "our" mean Tomorrow Begins Tonight Limited, trading as unsuited. "You" means anyone visiting the site or buying from us.

Reading legal terms is rarely fun. We have kept these as plain as we reasonably can. Please read them before you order. If you do not agree with them, please do not use the site. 

By using the site or buying from us, you agree to these terms and to our Privacy Policy.

Important: Nothing in these terms removes or limits your statutory rights as a consumer under Irish or EU law, in particular under the Consumer Rights Act 2022. Where a term in this document conflicts with those rights, your statutory rights apply.

 

SECTION 1 - WHO CAN USE THE SITE

 

You must be at least 18 to place an order with us. If you are under 18, you may only use the site under the supervision of a parent or guardian.

If you create an account, you are responsible for keeping your login details secure and for any activity carried out under your account. Please tell us straight away if you think your account has been used without your permission.

You may not transfer your account to anyone else.

 

SECTION 2 - OUR PRODUCTS

 
We try to show our products accurately. Colours and finish may look slightly different on your screen depending on your device and settings. We cannot guarantee that what you see on screen will exactly match the item you receive.

Product details, descriptions and availability may change. We may withdraw any product at any time and may limit how many of any item one customer can order.

This does not affect your statutory rights if a product is faulty, not as described, or not in conformity with the sales contract under the Consumer Rights Act 2022.

 

SECTION 3 - ORDERS

 

When you place an order on unsuited.com, you are making an offer to buy. The contract between us is formed when we send you an order confirmation email accepting your order. Until that point, we may decline or change your order at our discretion.

We may decline an order if a product is out of stock, if there is a pricing or description error, if we suspect fraud, or for any other reasonable reason. If we decline or change your order, we will let you know by email and refund any payment you have made for the affected items.

Please review your order carefully before submitting. We will try to accommodate cancellation requests received quickly, but once an order is in production for despatch we may not be able to stop it.

All purchases are intended for personal use, not for commercial resale.

 

SECTION 4 - RETURNS, EXCHANGES AND YOUR 30-NIGHT SLEEP TRIAL 

 

We make sleepwear that has to work in bed. The only honest way to find that out is to sleep in it. So every order comes with a 30-Night Sleep Trial, alongside a separate exchange option if you simply want a different size or set.

This 30-night window extends the statutory 14-day cancellation right under Part 5 of the Consumer Rights Act 2022, which gives effect to the EU Consumer Rights Directive in Ireland. Everything in this section applies to that statutory right as well.

 

THE 30-NIGHT SLEEP TRIAL (REFUNDS)

 

Sleep in your unsuited for up to 30 nights from the date you receive your order. If you're not happy with the fit, feel or comfort, return them for a full refund of the product price.

You can return items in any condition consistent with normal sleeping use. We ask that you launder them before sending, if you can.

To start a return, email hello@unsuited.com within 30 days of delivery. You can use the model cancellation form in our Refund Policy, or simply send a clear written statement that you are returning your order. We will reply with return instructions and our address.

 

EXCHANGES

 

If you'd prefer a different size or a different set rather than a refund, you have 30 days from delivery to request an exchange. To qualify, items must be unworn, unwashed, with hangtags intact and in their original packaging.

We will cover the cost of shipping the replacement item out to you. You cover the return postage on the original.

To start an exchange, email hello@unsuited.com within 30 days of delivery and tell us what you'd like instead.

 

POSTAGE AND REFUNDS

 

You are responsible for the cost of returning items to us. We recommend a tracked service. We cannot refund or replace items that do not reach us.

For refunds, we will refund the price of the goods and the cost of standard outbound delivery within 14 days of receiving the items back, or proof you have sent them, whichever is sooner. We do not refund express delivery upgrades.

 

WHAT WE DO WITH RETURNED ITEMS

 

We do not resell worn sleepwear. Items returned under the Sleep Trial are responsibly donated, recycled, or used internally for fit and quality reference. The cost is built into how we price the product.

 

FAIR USE

 

The Sleep Trial and exchange options are offered in good faith for customers genuinely trying our sleepwear. We reserve the right to refuse returns, refuse exchanges, or limit future orders where we reasonably believe the policy is being abused, for example through repeated order-and-return cycles by the same customer.

We may modify or end the Sleep Trial at any time. Changes will not affect orders already placed.

 

SECTION 5 - PRICES AND PAYMENT

 

Prices are shown in euro and include Irish VAT where applicable. Shipping is calculated at checkout and shown before you pay. We may run promotions or offer discount codes from time to time. Where promotion terms differ from these terms, the promotion terms apply for that promotion only.

We may correct pricing or description errors at any time, including after you have placed an order. If we discover an error after you have ordered, we will contact you and give you the option to reorder at the correct price or cancel for a full refund.

You confirm that the payment details you give us are accurate and that you are authorised to use them. Payment is taken at the point of order.

 

SECTION 6 - SHIPPING, DELIVERY AND RISK

 

Delivery times shown at checkout are estimates. We work to meet them but cannot guarantee them. Delays caused by carriers, customs or events outside our reasonable control are not our responsibility, though we will help you resolve them.

Unless we agree otherwise, we will deliver your order within 30 days of the order confirmation, in line with our obligations under the Consumer Rights Act 2022.

Risk in the goods passes to you when you (or someone you have nominated) take physical possession of them. Until then, the goods are our responsibility. If a parcel is lost or damaged in transit before delivery, contact us and we will arrange a replacement or refund.

 

SECTION 7 - CONFORMITY, QUALITY AND YOUR REMEDIES

 

Goods we sell come with the legal protections required by Part 2 of the Consumer Rights Act 2022. In short, the goods must conform with the sales contract. They must:

• match the description, type, quantity and quality we agreed;
• be fit for any particular purpose you told us about and we accepted;
• be fit for the purposes for which goods of the same type are normally used;
• match any sample or model we showed you before sale;
• be delivered with all the accessories and instructions you would normally expect;
• be of the quality and have the durability that is normal for goods of the same type.

If the goods are not in conformity with the contract, you have a hierarchy of remedies under the Act. In most cases this means you can ask us to repair or replace the goods first, and if that is not possible or not done within a reasonable time, you can ask for a price reduction or a refund. Some lacks of conformity entitle you to a refund straight away.

Under Irish law, you have up to six years to bring a claim relating to the goods. These rights apply alongside any commercial guarantee we offer and do not replace it.

 

SECTION 8 - INTELLECTUAL PROPERTY

 

The unsuited name, logo, product names, copy, photography, video and the design of this site are owned by Tomorrow Begins Tonight Limited or used under licence. They are protected by Irish, EU and international intellectual property law.

You may use the site for your own personal, non-commercial purposes. You may not copy, redistribute, modify or republish any of our content, or use our name or logo, without our written permission.

Other names, logos and trademarks shown on the site (for example Shopify, payment provider marks) belong to their respective owners.

 

SECTION 9 - THIRD-PARTY LINKS AND TOOLS

 

Our site may link to other websites, or include tools provided by other companies (for example payment processors, analytics, customer review platforms). We do not control those websites or tools and are not responsible for their content, accuracy or practices. If you follow a link to another site, please read its terms and privacy policy before using it.

Where we display customer reviews, we take reasonable steps to ensure they come from genuine customers, in line with our obligations under the Consumer Rights Act 2022.

 

SECTION 10 - SHOPIFY

 
Our store runs on Shopify. Shopify provides the underlying platform but is not a party to your purchase. Any sale or transaction is between you and unsuited. Personal information you submit through the site is processed by both unsuited and Shopify in line with our Privacy Policy and Shopify’s.

 

SECTION 11 - PRIVACY AND COOKIES

 

We take your privacy seriously. How we collect, use and protect your personal information is set out in our Privacy Policy. By using the site you confirm you have read it.

Our use of cookies and similar tracking is set out in our Cookies Policy and managed through the consent banner on the site.

 

SECTION 12 - FEEDBACK AND REVIEWS

 
If you send us feedback, suggestions, reviews or other content, you grant us a worldwide, royalty-free licence to use, edit and publish it in connection with our business. You confirm that the content is yours to give and does not infringe anyone else’s rights.

We may, but are not required to, moderate or remove content that we consider unlawful, misleading or inappropriate.

 

SECTION 13 - ACCEPTABLE USE

 

You agree to use our site lawfully and not to use it to:

• break any law or regulation;
• infringe our intellectual property or anyone else’s;
• harass, threaten or harm any person;
• send spam, scrape data, or run automated requests against the site;
• attempt to interfere with the site’s security, performance or other users;
• impersonate anyone else or misrepresent who you are;
• collect personal information about other users;
• upload viruses or malicious code.

We may suspend or close your account if we reasonably believe you have broken these rules.

 

SECTION 14 - SUSPENSION AND TERMINATION

 
We may suspend or end your access to the site at any time if you breach these terms or for any other reasonable reason. The sections of these terms that by their nature should continue after termination will continue to apply.

 

SECTION 15 - OUR LIABILITY

 

We are responsible for losses you suffer as a foreseeable result of our breach of these terms or our negligence.

We are not responsible for losses that were not foreseeable to both of us when the contract was made, or for losses caused by events outside our reasonable control.

Nothing in these terms limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any other liability that cannot be limited or excluded under Irish law; or our obligations under Part 2 of the Consumer Rights Act 2022 in relation to the conformity of goods.

If you are a consumer, this section does not affect your statutory rights.

 

SECTION 16 - CHANGES TO THESE TERMS

 
We may update these terms from time to time. The current version will always be posted on this page with the date it was last updated. If we make material changes, we will let you know by email or through a notice on the site, and the new terms will apply from the date stated. Your continued use of the site after that date means you accept the updated terms.

 

SECTION 17 - RESOLVING DISPUTES

 

If you have a problem with anything you have bought from us, please contact us first at hello@unsuited.com so we can try to put it right.

If we cannot resolve the issue between us, you have several options:

• You can use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr (EU consumers).
• You can contact the European Consumer Centre Ireland for help with cross-border disputes within the EU, Iceland or Norway.
• You can take a claim through the Small Claims Procedure in the Irish District Court for low-value disputes.
• You can complain to the Competition and Consumer Protection Commission (CCPC) in Ireland.

 

SECTION 18 - GOVERNING LAW AND COURTS

 
These terms are governed by the laws of Ireland. Any dispute will be dealt with by the courts of Ireland. If you live in another EU country, this does not affect your right to bring proceedings in your local courts where local law gives you that right.

SECTION 19 - OTHER

 

If any part of these terms is found to be unenforceable, the rest will continue to apply. Our failure to enforce a right under these terms is not a waiver of that right.

These terms, the Privacy Policy, the Refund Policy and any other policies we link to, make up the whole agreement between us about your use of the site.

You may not transfer your rights or obligations under these terms without our written consent. We may transfer ours where this would not affect your rights.
